General conditions
1. GENERAL INFORMATION
Q-TECH HOUSES DIVISION, SL UNIP (Q-TECH), with registered office in Rincón de la Victoria - 29730 (Málaga) and CIF B-92715523, registered in the Mercantile Registry 5 of Málaga, Folio 9, Volume 4003 General of Companies, Sheet No. MA-82846, Registration 1st; establishes the following general conditions of sale with its Client, with whom it makes a purchase-sale contract or, where appropriate, a service contract, it being understood that the buyer accepts said conditions when placing an order or requesting a service.
2. ORDERS
2.1. The features and specifications provided in our offers are for guidance only. Q-TECH reserves the right to make changes to the detailed features and specifications at any time and without prior notice in order to improve our products and services.
2.2. Orders must be placed in writing and must bear the customer's signature and, if applicable, reference the offer or quote. Any condition expressed by the buyer that does not conform to these general terms and conditions of sale, or those specified for each product, will be considered null and void unless accepted by us in the Order Acknowledgement.
2.3. Q-TECH reserves the right to cancel pending orders when the buyer has totally or partially breached any point of the contract signed between the parties.
2.4. Processing an order for special equipment or materials involves an advance payment of 50%.
2.5. Order cancellation will not be accepted in the following cases:
- When the cancellation is made after fourteen days have elapsed since the date of receipt of the order.
2.6. Any order modification will have to be accepted by Q-TECH and will always be considered a new order.
3. PRICES
3.1. The prices shown in the Offers and other documents (delivery notes and invoices) are those currently in force and are valid, except in the case of typographical errors. Prices I.V.A. included in the total of the document.
3.2. The prices shown in the Offers and other documents (delivery notes and invoices) do NOT include transport by truck to the construction site for Spain, unless expressly modified in the document.
3.3. The prices shown in the Offers and other documents (delivery notes and invoices) may be changed upon prior notification to the customer. These new prices will be applied to all pending orders.
3.4. The offers are subject, for all purposes, to the validity period established therein.
3.5. All taxes currently in force and those that may in the future levy the production, delivery of goods or sale of our products will be borne by the buyer, unless their pass-through is expressly prohibited.
4.DELIVERY TERMS AND CONDITIONS
4.1. Deliveries will be made by truck to the construction site and to a location accessible to the vehicle. If accessibility issues arise, the goods will be left at the nearest location agreed upon with the customer.

5. PAYMENT TERMS
5.1. The payment terms will be those indicated in our order confirmation or in the contract signed between the parties.
5.2. The customer will receive the purchase invoice by email, which must be kept for product warranty purposes. The customer may request their invoice at any time by email. adm@q-tech.es
5.2. The order may be automatically cancelled for non-payment with penalty for damages of the total amount delivered up to that point.
6. WARRANTY
6.1. Our products, provided they are used under normal conditions, are guaranteed for the period indicated on the invoice, in accordance with the conditions of use, maintenance, and the timeframes established by Q-TECH and the manufacturers. This does not apply to products with a different warranty period, such as those with special installations, which will be duly specified in writing.
6.2. To enjoy this guarantee, it will be necessary, in each case, to accept the defect by our Technical Department, and the defective products must be sent to the warehouse of origin that will be indicated beforehand, unless a visit by our staff from the Technical Department to the facilities is agreed.
6.3. Our guarantee only covers the replacement of the material at no charge to the buyer and in no case will we be responsible for any damages that may have occurred, directly or indirectly, due to its defect.
6.4. This warranty only covers the products, parts, or components mentioned in our Offers, for which the product, service, and/or installation warranty will be specified. For all other items purchased, our supplier's warranty remains in effect under the terms and conditions established by them.
6.5. It only covers manufacturing defects. It never covers operational defects caused by misuse and/or problems caused by the supply of electricity, water or adverse conditions.
6.6. For the warranty to be valid, the warranty card given to the customer must be properly stamped, indicating that the necessary inspections have been carried out. Otherwise, the product or installation will not be covered by the warranty.
6.7. The expenses, shipping, packaging, etc. arising from repairs covered by the warranty are the responsibility of the customer.
7. WITHDRAWAL POLICY
7.1. You have the right to withdraw from this contract within 14 calendar days without giving any reason.
7.2. The withdrawal period will expire 14 calendar days from the day on which you or a third party indicated by you, other than the carrier, acquired physical possession of the last of those goods.
7.3. To exercise the right of withdrawal, you must notify us Q-Tech Houses division s.l.u. // Address: Avda. de los Vegas, 70B - Pol. Ind.El Viso - Malaga // Telephone: 952972464 // email: info@q-tech.es their decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post, fax, or email). You may use the model withdrawal form below, although its use is not obligatory.
7.4. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of this right before the withdrawal period has expired.
7.5. Consequences of withdrawal. In the event of withdrawal on your part, we will refund all payments received from you. excluding Delivery costs (and any additional costs resulting from your choice of a delivery method other than our least expensive standard delivery option) will be refunded without undue delay and in any event no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will carry out such refund using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the refund.
7.6. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is the earliest.

The deadline will be considered met if you return the goods before the end of this period. You will have to bear the direct cost of returning the goods.
7.8. You will only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. You must bear the direct costs of returning these items; and you will be liable for any diminished value of the returned goods due to handling, or damage to the original packaging and its contents.

7.9. “The right of withdrawal will not applyto contracts that refer to:
a) The supply of finished goods
according to the consumer and user specifications or clearly customized.
b) The supply of goods that may deteriorate or expire rapidly.
c) The supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.
f) The supply of goods which, after delivery and taking into account their nature, have been inseparably mixed with other goods.
d) The supply of sealed audio or video recordings or sealed computer programs which have been unsealed by the consumer and user after delivery.
8. CLAIMS
8.1. In addition to the warranty, which covers our products and/or installations, we will address justified claims for errors or defects in the quantity of the products and any incidents related to supply, packaging, transport and incorrect installation, if we are notified within 3 days of receipt and/or installation.
